1. Acceptance of These Terms
Welcome. These Terms and Conditions (the "Terms") govern your access to and use of the websites, landing pages, opt-in pages, online tools, educational materials, and services made available to you by American Capital Life, LLC and the brands, websites, and content verticals operated under it, including pages marketed as "Do What Banks Do" and "529 Alternative" (529alternative.com), and content relating to retirement planning, annuities, long-term care alternatives, and education funding (collectively, "we," "us," "our," or the "Company").
You may access our content and services through our primary website at www.americancapitallife.com, through 529alternative.com, and through related sites, brands, landing pages, opt-in pages, social media channels, email, telephone, and partner websites operated on our behalf. All of these channels are referred to together in these Terms as the "Site."
By accessing or using the Site, creating an account, submitting information through a form or opt-in page, or otherwise interacting with our content or services, you agree to be bound by these Terms and by our Privacy Policy and our Financial and Insurance Disclosure, which are incorporated here by reference. Your acceptance is just as binding as if you had signed a written agreement. If you do not agree to these Terms, please do not use the Site.

Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, and share your information. Please review it carefully.
3. Educational Content; No Advice
The Site and all content on it are provided for general educational and informational purposes only and are not financial, investment, tax, legal, or insurance advice. You consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. If you provide a telephone number, you also agree to the contact-consent terms described in our Privacy Policy.
5. Your Account
If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree not to share, assign, or transfer your account to anyone else. We are not responsible for any loss arising from unauthorized use of your account. We reserve the right, in our sole discretion, to refuse service, terminate accounts, or remove or edit content at any time.
6. Eligibility and Children
The Site is intended for adults. We do not knowingly collect personal information from anyone under the age of 13. If you are under 18, you may use the Site only with the involvement and permission of a parent or guardian. Content relating to children's or juvenile policies and education funding is directed to parents, guardians, and other adults, not to children. If you believe a child under 13 has provided us information, please contact us at scott@americancapitallife.com and we will delete it.
7. Links to Third-Party Sites and Services
The Site may contain links to websites we do not own or control ("Linked Sites"). We provide these links only for your convenience. We are not responsible for the content, accuracy, or practices of any Linked Site, and a link does not imply our endorsement. Some services offered through the Site may be delivered by third parties. By using those services you consent to our sharing relevant information with the third party providing them.
8. Acceptable Use and Intellectual Property
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal, non-commercial use, in accordance with these Terms. You agree not to use the Site for any unlawful purpose, and not to damage, disable, overburden, or interfere with the Site or anyone else's use of it.
All content on the Site, including text, graphics, logos, images, video, audio, course materials, frameworks, and the compilation and arrangement of that content, is owned by us or our licensors and is protected by copyright, trademark, and other laws. You agree not to copy, reproduce, republish, distribute, modify, reverse engineer, create derivative works from, sell, or otherwise exploit any of our content without our prior written permission. Our content is not for resale, and you acquire no ownership rights by using the Site.
9. User Submissions and Communication Features
The Site may include comment sections, chats, forms, communities, or other features that let you submit or post content ("Submissions"). You agree not to post anything that is unlawful, defamatory, harassing, infringing, obscene, deceptive, or that violates anyone's rights. You also agree not to upload viruses or malicious code, not to use the features to advertise, spam, or run schemes, and not to harvest others' information without consent.
We do not claim ownership of your Submissions. However, by submitting content you grant us a worldwide, royalty-free, perpetual license to use, copy, display, reproduce, adapt, and publish that content in connection with operating and promoting our business, including the right to publish your name alongside it. We are not obligated to use or keep any Submission and may remove content at any time. We have no obligation to monitor communication features, but we reserve the right to review and remove content and to terminate access at our discretion.
10. Disclaimer of Warranties
The Site and all content and services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. While we work to provide reliable information, we do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information is accurate, complete, or current. 11. Limitation of Liability
To the maximum extent permitted by law, in no event will the Company or its owners, officers, employees, affiliates, or service providers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or services or your inability to use them, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total cumulative liability to you for any claim will not exceed the greater of $100 or the amount you paid us, if any, for the product or service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. If you are dissatisfied with the Site, your sole and exclusive remedy is to stop using it.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its owners, officers, employees, agents, and affiliates from any claims, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your Submissions, your violation of these Terms, or your violation of any law or third-party right.
13. Arbitration and Class Action Waiver
Please read this section carefully, because it affects your legal rights.
If a dispute arises between you and the Company relating to these Terms or your use of the Site that cannot be resolved informally, you and the Company agree that it will be resolved exclusively by final and binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association, or a comparable service the parties agree on, before a single neutral arbitrator, in a location mutually agreed upon. The arbitrator's award is final and may be entered in any court with jurisdiction.
Class Action Waiver: All disputes will be conducted on an individual basis only. Class, collective, consolidated, and representative actions are not permitted. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims. This section survives termination of these Terms.
14. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, in our sole discretion.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Palm Beach County, Florida for any matter not subject to arbitration. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
16. Changes to These Terms
We may update these Terms at any time in our sole discretion. The most current version supersedes all prior versions. We encourage you to review these Terms periodically. Your continued use of the Site after changes are posted means you accept the updated Terms.

This Privacy Policy explains how American Capital Life, LLC and the brands, websites, and content verticals operated under it, including pages marketed as "Do What Banks Do" and "529 Alternative" (529alternative.com), and content relating to retirement planning, annuities, long-term care alternatives, and education funding ("we," "us," or "our"), collect, use, share, and protect your personal information in connection with our websites, landing pages, opt-in pages, mobile properties, and other digital channels that link to this Policy (collectively, the "Sites"), and with the educational materials, content, and services we provide (the "Services").
Protecting your information is a priority. We do not sell your personal information. We use commercially reasonable technical, physical, and administrative safeguards to protect it. By using the Sites and Services, you consent to the practices described in this Policy.
We may update this Policy at any time and will take steps required by law to notify you of material changes. Your continued use after an update means you accept the revised Policy.

The information we collect depends on how you interact with us. It may include the following.
Information you provide to us directly, such as when you fill out a form, opt-in page, or survey; subscribe to a newsletter, download a resource, or register for a webinar or event; request information, a consultation, an estimate, or a quote; communicate with us or our representatives by phone, text, email, chat, or video; or create an account. This may include your name, email address, phone number, mailing address, and, if you request financial or insurance-related information, additional details you choose to share such as your age, household and family information, financial goals, or general financial situation.
Information collected automatically when you use the Sites ("Usage Information"), such as your browser and device type, operating system, IP address, the page or link that referred you, pages viewed, and analytics data. We use this to operate, secure, analyze, and improve the Sites.
Information from third parties, such as social media or login platforms you use to access our content, advertising partners, and referral partners who direct you to us.
2. How We Use Your Information
We use your information to provide, maintain, and improve the Sites and Services; respond to your inquiries and requests; send newsletters, educational content, and marketing communications you have opted into, and measure engagement with them; connect you with relevant products, services, or licensed professionals where you have requested them; personalize and improve your experience; conduct analytics, research, and benchmarking, including in aggregated or de-identified form; and detect and prevent fraud, protect our rights and the safety of others, and comply with applicable laws and legal process.
3. How We Share Your Information
We may share your information with service providers and contractors who help us operate the Sites and Services, such as hosting, email delivery, analytics, customer support, scheduling, and advertising; with licensed professionals, insurance carriers, or partners when you ask us to connect you with a product or service, or to provide information you have requested; with referral partners, if you were referred to us, as needed to honor our arrangement with them and provide what you requested; with corporate affiliates and, in the event of a merger, sale, financing, or similar transaction, with parties to that transaction; and with authorities or others when we believe disclosure is required by law or legal process, or necessary to protect rights, property, or safety. We do not sell your personal information.
4. Text Messages and Phone Contact Consent
If you provide your telephone number through an opt-in page, form, or other request, you agree that we and our representatives may contact you at that number, including by phone call and text message, for purposes related to your request, our Services, and relevant products. Where required by law, we will obtain your prior express written consent before sending marketing calls or texts using automated technology, and that consent is not a condition of any purchase. Message and data rates may apply, message frequency varies, and you can opt out of texts at any time by replying STOP or contacting us at scott@americancapitallife.com. You can opt out of marketing calls by telling us during any call or by contacting us directly.
5. Financial Privacy (Gramm-Leach-Bliley Act)
Because we may assist you with insurance and related financial products, we may be treated as a financial institution under the federal Gramm-Leach-Bliley Act and applicable state insurance privacy and data security laws. When that applies, we limit how we collect, use, and disclose your nonpublic personal financial information, and we will provide you with any privacy notice required by those laws at the time and in the manner they require. We maintain safeguards designed to protect that information, as described below.
6. Cookies and Tracking Technologies
Our Sites use cookies, pixels, web beacons, and similar technologies to recognize you, remember your preferences, analyze traffic, measure the performance of our content and ad campaigns, and support advertising, including retargeting on third-party platforms such as Facebook (Meta) and Google. Some cookies may persist for 90 days or more.
Most browsers let you block or delete cookies through their settings. You can also use privacy-focused browsers or plug-ins. Please note that some features may not work properly if you disable cookies. Where required by applicable state law, we honor recognized universal opt-out signals such as the Global Privacy Control (GPC). We do not currently respond to other browser "Do Not Track" signals.

7. How We Protect Your Information

8. Your Privacy Choices and State Rights
You can opt out of marketing emails at any time using the unsubscribe link in any message or by emailing scott@americancapitallife.com, and you can opt out of texts by replying STOP.
Depending on the state where you live, you may have rights regarding your personal information, which can include the right to know or access the personal information we hold about you, to correct it, to delete it, to obtain a copy of it, and to opt out of the sale of personal information, targeted advertising, or certain profiling. A growing number of states, including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, have enacted comprehensive privacy laws that may provide these rights to their residents. We will verify your request as required by law and will not discriminate against you for exercising your rights. 9. Children
We do not knowingly collect personal information from children under 13. Our content relating to children's or juvenile policies and education funding is directed to parents, guardians, and other adults, not to children. 10. Users Outside the United States
The Sites and Services are intended for U.S. residents and are governed by U.S. law. If you access them from outside the United States, your information will be processed in the United States, and you are responsible for compliance with your local laws.
